Trust claim scenarios
Texas unclaimed property claims for trusts
A trust claim depends on who has authority to act and how the trust connects to the property. I work through that document trail, prepare the claim and manage the follow-up.
The trust is active
The trustee commonly acts for the trust. The supporting records need to connect the trustee, the trust and the reported property, especially when a name or trustee has changed.
There is a successor trustee
Succession must be documented. The trust terms and other records available for that particular trust can determine what will establish the new trustee’s authority.
The trust is no longer active
The beneficiaries and the trust’s terms may determine the claim path. The records showing what happened after the trust ended matter more than a simple “closed” label.
A will leaves property to a trust
An estate and a trust can be part of the same chain. I review how the will identifies the trust and who has authority at each step.
Three Trust Case Studies
EXAMPLE 01
Marina Blake and the Blake Family Trust
Active trust and current trustee
Property was reported in the Blake Family Trust’s name, and Marina was its current trustee. I matched the trust document and recent trust records to the reported property, documented Marina’s authority and prepared the claim for the trust.
EXAMPLE 02
Colin Myers and the Myers Legacy Trust
Successor trustee
The trustee named in older records was no longer acting, and Colin had taken over. I traced the succession through the trust terms and supporting records, then established Colin’s authority to claim on the trust’s behalf.
EXAMPLE 03
Rose Carter, Owen Carter and the Carter Family Trust
Beneficiaries after a trust ended
The Carter Family Trust was no longer active, and Rose and Owen were named as beneficiaries. I reviewed the trust terms and final records to establish their respective interests and prepared the claim around their shares.
These claims turned on different questions: who could act for an active trust, how a new trustee’s authority was established and who was entitled to the property after a trust ended. I built each file around the trust’s terms and the available records.
